NORMATIVA ZEDE NO. 00 002-2020

LA COMISIÓN PERMANENTE DEL COMITÉ PARA LA ADOPCIÓN DE MEJORES PRÁCTICAS (CAMP),

CONSIDERANDO: Que un atributo esencial de la soberanía de un estado es su derecho a expropiar para uso público cualquier inmueble dentro de sus fronteras.

CONSIDERANDO: Que los artículos 103, 104, 105 y 106 de la Constitución de la República y 21 de la Convención Americana sobre Derechos Humanos establecen los parámetros, límites y condiciones del derecho de expropiación que corresponden al Estado de Honduras a través de sus órganos competentes.

CONSIDERANDO: Que la Ley Orgánica de las Zonas de Empleo y Desarrollo Económico (ZEDE) reserva al Estado de Honduras su derecho soberano y constitucional de expropiar para uso público cualquier inmueble dentro de sus fronteras en sus artículos 25, 26 y 28.

CONSIDERANDO: Que no obstante lo anterior, siendo que el régimen especial de las Zonas de Empleo y Desarrollo Económico (ZEDE) busca como objetivo primordial asegurar de mejor manera el respeto a los derechos y garantías contenidos en la Constitución de la República y los Tratados Internacionales de las que Honduras forma parte.

CONSIDERANDO: Que tanto la Constitución de la República en sus artículos 103, 104, 105 y 106, como la Convención Americana Sobre Derechos Humanos en su artículo 21 garantizan el derecho a la propiedad privada sin mas limitaciones que las que aquellas fundamentadas en el interés público.

CONSIDERANDO: Que el numeral 1) del artículo 11 de la Ley Orgánica de las ZEDE confiere al CAMP la facultad de aprobar su normativa interna.

CONSIDERANDO: Que el numeral 4) del artículo 11 de la Ley Orgánica de las ZEDE confiere al CAMP la facultad de establecer los lineamientos generales de política interna y transparencia de las ZEDE.

CONSIDERANDO: Que el numeral 5) del artículo 11 de la Ley Orgánica de las ZEDE confiere al CAMP la facultad de aprobar o improbar la normativa aprobada por un Secretario Técnico.

CONSIDERANDO: Que los poderes necesarios para emitir esta política han sido delegados a la Comisión Permanente por el CAMP.

POR LO TANTO,

APRUEBA LA SIGUIENTE NORMATIVA:

Normativa para Regular las Disposiciones Relativas a la Facultad de Expropiación Contenidas en los Artículos 25, 26 y 28 de la Ley Orgánica de las Zonas de Empleo y Desarrollo Económico (ZEDE)

Artículo 1.- La presente normativa constituye un lineamiento de política general aplicable tanto a las Zonas de Empleo y Desarrollo Económico autorizadas a la fecha como a las que se autoricen en el futuro. La misma se aprueba de conformidad con lo dispuesto en el numeral 4 del artículo 11 de la Ley Orgánica de las Zonas de Empleo.

Artículo 2.- El derecho de expropiación corresponde exclusivamente al Estado de Honduras a través de sus órganos competentes y de acuerdo a los parámetros, límites y condiciones establecidos en los artículos 103, 104, 105 y 106 de la Constitución de la República y 21 de la Convención Americana sobre Derechos Humanos, incluyendo la indemnización justipreciada previa. Ninguna ZEDE tiene el poder de realizar expropiaciones por si misma en áreas fuera del ámbito espacial de competencia que les haya sido autorizado de conformidad a los limites establecidos en la escritura de incorporación y el plano acompañado a la misma.

Artículo 3.- La disposición contenida en el artículo 25 de la ley orgánica relativo a la capacidad del Estado de realizar expropiaciones de tierras no otorga a los Secretarios Técnicos ni a ninguna otra autoridad del régimen de las Zonas de Empleo y Desarrollo Económico (ZEDE) la facultad de realizar expropiaciones de forma unilateral sobre tierras de carácter privado. Dichas expropiaciones solamente pueden ser realizadas por los órganos del Estado competentes y deben sujetarse a lo dispuesto en la Constitución de la República y las leyes vigentes que rigen los temas de expropiación para megaproyectos de infraestructura. El Comité para la Adopción de Mejores Prácticas (CAMP) no admitirá proyectos a desarrollarse sobre tierras expropiadas salvo que se den las siguientes condiciones:

(i) Que se trate de proyectos cuyo titular sea el Estado de Honduras o en los cuales este tenga una participación no menor al 50%

(ii) Que se demuestre plenamente mediante un análisis costo-beneficio exhaustivo el valor del proyecto en el desarrollo de las comunidades Aledañas

(iii) Que se haya otorgado la oportunidad a el o los propietarios de las tierras para incorporar las mismas como socio del proyecto en forma voluntaria

(iv) Que se haya respetado el derecho de ese propietario a un debido proceso.

(v) Que no haya comunidades asentadas, personas viviendo de forma permanente o negocios operando sobre las tierras que se pretenda expropiar ni se hayan producido desalojos de poseedores legítimos sobre las mismas.

(vi) Que la indemnización haya sido previamente pagada o consignada y no existan conflictos relativos al monto de la indemnización

(vii) Que se demuestre fehacientemente que se analizaron alternativas a la expropiación y que de no hacerse ésta el proyecto no podría llevarse a Cabo.

Artículo 4.- La facultad para incorporar tierras para expansión del ámbito espacial de una ZEDE contenida en el artículo 28 no corresponde a los Secretarios Técnicos ni a ninguna otra autoridad del régimen ZEDE el poder para declarar la misma. Dicha declaratoria solo pueden hacerla los órganos competentes del Estado de Honduras y deben sujetarse a lo dispuesto en la Constitución de la República y las leyes vigentes que rigen los temas de expropiación para megaproyectos de infraestructura, así como a las condiciones establecidas en el artículo anterior de esta normativa.

El CAMP solo admitirá la incorporación de tierras expropiadas para fines de expansión del ámbito espacial de competencia de una ZEDE cuando el desarrollador de la misma fuere el propio Estado y sobre las mismas no existen asentamientos humanos al momento de perfeccionarse la expropiación. Tampoco se admitirá la incorporación de tierras sobre las cuales se hubieren producido desalojos de poseedores legítimos.

Artículo 5.- Se declara que la interpretación del CAMP de la Ley Orgánica de las ZEDE se guía por el hecho de que las ZEDE no tienen autoridad unilateral para expropiar fuera de sus ámbitos espaciales con el propósito de expandir su territorio.

Artículo 6.- La autoridad del Secretario Técnico de una Zona de Empleo y Desarrollo Económico (ZEDE) comprende únicamente aquellos terrenos o parcelas ubicados dentro de su ámbito espacial de competencia y está sujeta a las limitaciones establecidas en la Constitución de la República, los tratados internacionales de los que Honduras forma parte y su normativa interna.

Es política permanente del Comité para la Adopción de Mejores Prácticas (CAMP) no aprobar ninguna norma o acción de un Secretario Técnico que pretenda llevar a cabo la expropiación de un inmueble con el fin de ampliar el ámbito espacial de competencia de la Zona de Empleo y Desarrollo Económico (ZEDE) que representa en virtud de la limitación establecida en el párrafo anterior.

Artículo 7.- Con respecto a cualquier ejercicio interno de la facultad de expropiación, el Comité para la Adopción de Mejores Prácticas (CAMP) adopta una política permanente de no aprobar ningún acto de expropiación de un Secretario Técnico, a menos que:

(i) Dicha expropiación sea imprescindible para la construcción de un proyecto de beneficio público claramente definido.

(ii) No exista una alternativa viable para la construcción del proyecto de infraestructura específico.

(iii) No haya sido posible llegar a un acuerdo con el propietario y la falta de éste impida la construcción de la obra.

(iv) Se haya respetado el derecho de ese propietario a un debido proceso.

(v) Se limite a la cantidad de terreno necesaria para permitir la construcción de la obra y, si hay viviendas, se proporcionen viviendas de igual o mejor condición en un sitio alternativo que reúna condiciones similares a las originales.

(vi) La compensación sea previa, rápida, adecuada y efectiva. Esto incluye que la indemnización sea por lo menos el valor de mercado del inmueble, que se determinará sobre la base de los precios de venta recientes de inmuebles similares en lugares cercanos o comparables previo al anuncio de la construcción de la obra.

(vii) El valor catastral de un bien no sea utilizado como base para determinar el valor de mercado del mismo.

ZEDE LEGISLATION NO. 00 002-2020

THE PERMANENT COMMISSION OF THE COMMITTEE FOR ADOPTION OF BEST PRACTICES (CAMP),

WHEREAS: An essential attribute of the sovereignty of a State is its right to expropriate any property for public use within its borders.


WHEREAS: The articles 103, 104, 105, and 106 of the Constitution of the Republic, and 21 of the American Convention on Human Rights establish the parameters, limits, and conditions of the right to expropriate that correspond to the State of Honduras through its competent bodies.

WHEREAS: The Organic Law of the Zones of Employment and Economic Development (ZEDE) reserves for the State of Honduras its sovereign and constitutional right to expropriate any properties for public use within its borders in its articles 25, 26, and 28.

WHEREAS: Notwithstanding the above, the special regime of the Zones of Employment and Economic Development (ZEDE) seeks to ensure respect to the rights and guarantees contained in the Constitution of the Republic and the International Treaties Honduras forms part of as a primary objective.


WHEREAS: Both, the Constitution of the Republic in its articles 103, 104, 105 and 106, as well as the American Convention on Human Rights in its Article 21, guarantee the right to private property without any limitations other than those grounded in public interest.


WHEREAS: The numeral 1) in Article 11 of the Organic Law of the ZEDEs confers upon the CAMP the power to approve its internal legislation.

WHEREAS: The numeral 4) in Article 11 of the Organic Law of the ZEDEs confers upon the CAMP the power to establish the general guidelines for the internal policy and transparency of the ZEDEs.

WHEREAS: The numeral 5) in Article 11 of the Organic Law of the ZEDE confers upon the CAMP the power to approve or disapprove the legislation approved by a Technical Secretary.

WHEREAS: The necessary powers to issue this policy have been conferred upon the Permanent Commission by the CAMP.

THUS,

APPROVES THE FOLLOWING LEGISLATION:

Legislation to Regulate the Provisions Relating to the Faculty of Expropriation Contained in Articles 25, 26 and 28 of the Organic Law of the Zones of Employment and Economic Development (ZEDEs)

Article 1.- This legislation constitutes a general policy guideline applicable to both, the Zones of Economic Development and Employment authorized to date and to the ones to be authorized in the future. It is approved in accordance with the numeral 4 of Article 11 of the Organic Law of the Zones of Employment.

Article 2.- The right of expropriation corresponds exclusively to the State of Honduras through its competent bodies and in accordance with the parameters, limits, and conditions established in articles 103, 104, 105 and 106 of the Constitution of the Republic and article 21 of the American Convention on Human Rights, including the previous just indemnification. No ZEDE has the power to perform expropriations by itself in areas outside the spatial ambit of competence authorized in accordance with the limits established in the deed of incorporation and the plan accompanied to it.


Article 3.- The disposition contained in article 25 of the Organic Law relative to the State capacity to expropriate land does not grant the Technical Secretaries or any other authority of the Zones of Employment and Economic Development (ZEDEs) the power to expropriate land of a private nature in unilateral manner. These expropriations can only be carried out by the competent State bodies, and must be subject to the provisions in the Constitution of the Republic and the laws in force that govern expropriation issues for infrastructure megaprojects. The Committee for the Adoption of Better Practices (CAMP) will not admit projects to be developed on expropriated land, unless they have the following conditions:


(i) Projects whose owner is the State of Honduras or in which the State has a participation at least 50%.

(ii) The value of the project in the development of the surrounding communities is fully demonstrated by an exhaustive cost-benefit analysis.


(iii) The opportunity has been granted to the owner(s) of the land to incorporate them as a voluntary partner in the project.


(iv) The owner's right to due process has been respected.


(v) There have been neither settled communities, people living permanently, or businesses operating on the lands intended for expropriation, nor evictions of legitimate owners of the before mentioned properties.

(vi) The indemnification has been previously paid or consigned, and there are no conflicts regarding the amount of the compensation.

(vii) It is reliably demonstrated that alternatives to the expropriation were analyzed, and that if the expropriation is not done, the project could not be carried out.

Article 4.- The faculty to incorporate lands for expansion of the spatial ambit of a ZEDE contained in article 28 does not give the Technical Secretaries or any other authority of the ZEDE regime the power to declare them as incorporated. Such declaration can only be made by the competent bodies of the State of Honduras and must be subject to the provisions in the Constitution of the Republic and the current laws about expropriation for infrastructure megaprojects as well as the conditions established in the previous article of this legislation.


The CAMP will only admit the incorporation of expropriated lands for purposes of expansion of the spatial ambit of competence of a ZEDE when the developer of such is the State and there are no human settlements at the time of the expropriation. The incorporation of the lands on which there has been an eviction of legitimate proprietors will not be admitted either.

Article 5.- It is declared that the interpretation of the CAMP of the Organic Law for the ZEDEs will be guided by the fact that the ZEDEs do not have unilateral authority to expropriate outside of their spatial ambit with the purpose to expand its territory.

Article 6.- The authority of the Technical Secretary of a Zone of Employment and Economic Development (ZEDE) includes only those lands or plots located within its spatial ambit of competence, and is subject to the limitations established in the Constitution of the Republic, the international treaties Honduras is a part of, and its internal legislation.

It is permanent policy of the Committee for Adoption of Best Practices (CAMP) is not to approve any norm or action of a Technical Secretary that intends to carry out the expropriation of a property with the end goal to expand the spatial ambit of competence of the Zone of Employment and Economic Development (ZEDE) that is represented in virtue of the limitation established in the previous paragraph.

Article 7.- With respect to any internal exercise of the faculty of expropriation, the Committee for Adoption of Best Practices (CAMP) adopts a permanent policy not to approve any act of expropriation by a Technical Secretary, unless:


(i) The said expropriation is absolutely necessary for the construction of a project of clearly defined public benefit.

(ii) There is no viable alternative for the construction of the specific infrastructure project.

(iii) It has not been possible to reach an agreement with the owner and the lack of it prevents the construction work.

(iv) The owner's right to due process has been respected.

(v) The amount of land necessary to allow the construction is limited, and if there are houses, housing of equal or better condition will be provided to their owners in an alternative place that meets conditions similar to the original.

(vi) The compensation should be given ahead of time, and should be fast, adequate and effective. This includes that indemnification should be at least equal to the market value of the property, which will be determined on the basis of recent property sales prices in nearby or comparable locations prior to the announcement of the construction work.

(vii) The cadastral value of an asset will not be used as a basis to determine its market value.
