DECREE No.368-2013

NATIONAL CONGRESS.

WHEREAS: By Decree 236-2012 dated January 23, 2013, published in the Official Gazette on January 24, 2013, it amended Articles 294, 303 and 329 of the Constitution of the Republic, ratified by Decree Number 9 dated January 30, 2013, published in the Official Gazette on March 20, 2013, authorizing the creation of Zones of Employment and Economic Development (ZEDE).

WHEREAS: The purpose of the creation of the Zones of Employment and Economic Development (ZEDE), is to generate sources of employment that guarantee development opportunities in the spheres of health, education, infrastructure, public security, among others; to improve the living conditions of the Honduran population.

WHEREAS: Article 11 of the Organic Law of Zones of Employment and Economic Development (ZEDE) creates the Committee for Adoption of Best Practices (CAMP) to comply with specific functions.

WHEREAS: The penultimate paragraph of Article 11 of the Organic Law of Zones of Employment and Economic Development (ZEDE) designates the National Congress of the Republic to ratify the appointment of the members of said committee.

THEREFORE,

D E C R E E S

ARTICLE 1.- Ratify the appointment made by the President of the republic in the Executive Agreement No. 003-2014 dated January 14, 2014 which literally says:

"EXECUTIVE AGREEMENT NUMBER 003-2014.- THE PRESIDENT OF THE REPUBLIC, WHEREAS: The Articles 294, 303 and 329 of the constitution of the Republic were reformed by Decree 236-2012 dated January 23, 2013; published in "La Gaceta" Official Gazette of the republic, on January 24, 2013, ratified by Decree Number 9 dated January 30, 2013, published in "La Gaceta", Official Gazette of the Republic on March 20, 2013, authorizing the creation of Zones of Employment and Economic Development (ZEDE).- WHEREAS: The purpose of the creation of the Zones of Employment and Economic Development (ZEDE), is to generate sources of employment that guarantee development opportunities in the spheres of health, ducation, infrastructure, public security, among others; to improve the living conditions of the Honduran population.- WHEREAS: Article 11 of the Organic Law of Zones of Employment and Economic Development (ZEDE) creates the Committee for Adoption of Best Practices (CAMP) to comply with specific functions, which will be integrated by twenty-one (21) persons of recognized good repute, leadership, executive capacity and international prestige in the private for-profit or non-profit sector, in the academia or in the private sector.- WHEREAS: The penultimate paragraph of Article 11 of the Organic Law of Zones of Employment and Economic Development (ZEDE) designates the President of the Republic to appoint the members of said committee and that appointment must be ratified by the National Congress. THEREFORE, In application of articles 245 numeral 11 and 329 of the Constitution of the Republic; 118 of the General Law of Public Administration and 11 of the Organic Law of the Zones of Employment and Economic Development (ZEDE).- AGREES: ARTICLE 1.- To appoint the following persons as members of the Committee for the Adoption of Best Practices (CAMP) 1.- KAKHA BENDUKIDZE; 2.- MORTON BLACKWELL; 3.- ALEJANDRO CHAFUEN; 4.- LARS SEIER CHRISTENSEN; 5.- ALEX CRANBERG; 6.- EBAL JAIR DIAZ LUPIAN; 7.- ENRIQUE GHERSI; 8.- BARBARA KOLM; 9.- MARK KLUGMANN; 10.- RICARDO RODOLFO MADURO JOEST; 11.- GROVER NORQUIST; 12.- OCTAVIO RUBÉN SÁNCHEZ BARRIENTOS; 13.- SURSE PIERPOINT; 14.- RICHARD RAHN; 15.- MICHAEL REAGAN; 16.- MARK SKOUSEN; 17.- LOREN SMITH; 18.- RICARDO LEONEL CARDONA LÓPEZ; 19.- GABRIELA VON HABSBURG; 20.- SALEM BEN NASSER ALISMAILY; Y, 21.-FAITH RYAN WHITTLESEY.- ARTICLE 2.- The replacements of these persons will be will be completed in the manner indicated in Article 11 numeral 7) of the Organic Law of the Zones of Employment and Economic Development (ZEDE) contained in the Legislative Decree Number 120-2013, published in "La Gaceta", Official Gazette of the Republic on September 6, 2013. ARTICLE 3.- The present Executive Agreement will enter into force upon ratification by the National Congress and it must be published in "La Gaceta", Official Gazette of the Republic.- Given in the City of Tegucigalpa, Municipality of the Central District, in Presidential House, at fourteen (14) days of the month of January of the year two thousand fourteen (2014)."

ARTICLE 2.- To extend the validity of the Article 2 of Legislative Decree Number 153-2013 until January 27, 2018.- The ZEDE may instruct directly to the trustee to access the funds they need or sign an agreement with COALIANZA which will serve as an irrevocable mandate to the trustee, instructing the deadlines and how the purposes of this provision will be complied.

ARTICLE 3.- The companies that operate within the Zones of Employment and Economic Development (ZEDE) that sell products, goods or services in the rest of the country must pay the same duties and/or taxes to which the products, goods or services are subject when they are nationalized from a free zone, in accordance with current customs legislation.

ARTICLE 4.- This Decree will enter into force from the day of its publication in the official Gazette.

Given in the city of Tegucigalpa, municipality of the Central District, in the Sessions Room of the National Congress, on the twentieth day of January in the year two thousand and fourteen.
